These general terms and conditions of sale (« GTC ») govern the contractual relationship between Le Grand Chalet, Chem. de la Source 2, 1854 Leysin(hereinafter « the establishment » or « the hotel »), and any person making a reservation (hereinafter « the customer »). Any reservation, through whatever channel, implies full and unreserved acceptance of these terms and conditions.
1. Scope of application
These GTC apply to all services offered by Le Grand Chalet, whether accommodation, restaurant services, wellness services (Espace Nérine), seminars, after-work events, events or gift vouchers. They prevail over any contrary condition that may appear in the customer's documents, except with the express written agreement of the establishment.
In the event of a reservation made through a third-party platform (Booking.com, Expedia, Freedreams, etc.), the specific terms of the platform prevail with regard to the conclusion of the contract ; these GTC remain applicable on a subsidiary basis for the provision of services on site.
2. Reservation and conclusion of the contract
The contract is deemed concluded as soon as the reservation has been confirmed by the establishment, by email, by telephone or via a reservation platform. The reservation confirmation, together with these GTC, constitutes the entire agreement between the parties.
Any reservation is strictly personal ; subletting or assignment to a third party is prohibited without the prior written consent of the establishment.
The hotel reserves the right to refuse a reservation, without having to justify its decision, in particular in the event of a prior dispute, doubt as to the customer's solvency, or if the request appears contrary to public morals or to the security of the establishment.
Reservations by a minor are not permitted without the written consent of the legal representative.
3. Prices and tourist tax
Prices are stated in Swiss francs (CHF), including Swiss VAT at the applicable rate. Unless otherwise stated, they include the tourist tax.
Exception :for reservations made via gift vouchers or partner platforms (e.g. Freedreams), the tourist tax is payable on site :
- CHF 3.80 per adult per night
- CHF 1.90 per child (6 to 15 years old) per night
The rates published on the website are provided for information purposes only and may change at any time. Only the rate confirmed at the time of reservation shall prevail.
4. Payment terms and guarantee
A valid credit card is required to guarantee the reservation. The establishment reserves the right to perform a pre-authorisation before arrival in order to verify the validity of the card and to guarantee payment.
The balance of the stay as well as any extras are due at the latest at the time of departure. Accepted means of payment are : cash (CHF, EUR), credit cards (Visa, Mastercard, American Express subject to availability), Twint and bank transfer before arrival on request.
In the event of non-payment by the due date, default interest at the legal rate (5 % per year, Art. 104 Swiss Code of Obligations (CO)) as well as reminder fees may be charged.
5. Cancellation and modification conditions
The applicable cancellation conditions are those communicated to the customer at the time of reservation and which appear on the confirmation. Failing any specific mention, the following conditions apply on a subsidiary basis :
- free cancellation up to 48 hours before arrival (local time) ;
- beyond that, the amount corresponding to the first night may be charged ;
- in the event of no-show or early departure, the entire booked stay may be charged.
Any request for modification must be sent to the establishment in writing, as soon as possible. Modifications are accepted subject to availability.
The establishment recommends that customers take out cancellation insurance with their insurer or travel agency.
6. Arrival and departure
- Check-in : from 3.00 p.m.
- Check-out : until 11.00 a.m.
Late arrivals (after 9.00 p.m.) must be announced to the establishment. Late departure may be granted subject to availability, for an additional charge of CHF 50.–.
In accordance with the cantonal ordinance of Vaud on the foreign nationals police, each adult guest must present an official identity document on arrival. The data necessary for the issuance of the guest card is collected under the conditions specified in our privacy policy.
7. Children and extra beds
- Children up to 5 years old : free in the room of two paying adults
- Children from 6 to 15 years old : CHF 30.– per night
- Baby cot : free, on request
Minors remain under the responsibility of their parents or accompanying persons throughout the duration of the stay, including in common areas and wellness facilities.
8. Pets
Dogs are admitted for an additional charge of CHF 10.– per night, to be reported at the time of reservation. Other animals are admitted subject to prior agreement.
The customer is responsible for their animal and for any damage or nuisance it may cause. Animals are not allowed in the restaurant or in the wellness areas, with the exception of duly identified assistance dogs.
9. Internal rules
The establishment is entirely non-smoking, in accordance with the cantonal legislation of Vaud. In the event of non-compliance (smell of smoke, ashes, smoke-related damage), restoration costs of up to CHF 500.– may be charged.
Customers are required to respect the peace and quiet of other occupants and the establishment's staff. Night-time quiet hours are observed from 10.00 p.m. to 7.00 a.m.
The hotel reserves the right to exclude, without refund, any customer whose behaviour would harm the security, morality or reputation of the establishment.
10. Liability and damages
The customer is responsible for any damage caused to the establishment, its furniture or equipment during their stay. Repair or replacement costs will be charged.
In accordance with Articles 487 et seq. of the Swiss Code of Obligations, the hotelier is liable for damage caused to property brought in by the customer up to CHF 1'000.–, except in the event of fault on the part of the customer or their accompanying persons. The hotelier's liability is unlimited in the event of fault on their part or that of their auxiliaries.
For valuables, cash or jewellery, the hotel provides a safe. In the absence of such deposit, the establishment's liability remains limited under the aforementioned conditions.
11. Wellness area and pool
Access to the wellness areas (sauna, jacuzzi, treatment area) is subject to the rules posted on site. Customers access them at their own risk. Booked treatments and massages are subject to specific cancellation conditions communicated at the time of reservation.
12. Gift vouchers
Gift vouchers are valid for 12 months from their date of issue, unless otherwise indicated. They are neither refundable nor exchangeable for cash. The booking of services covered by the gift voucher is subject to availability and must be made in advance.
13. Personal data
In the context of reservations, personal data, including credit card data, is collected. This data is processed securely via our systems and providers (in particular PCI-DSS certified) and in accordance with the Swiss Federal Act on Data Protection (nFADP). Credit card data is deleted or anonymised no later than 30 days after departure, except in the event of an ongoing dispute or refund.
The customer has a right of access, rectification, deletion and objection. The procedures for exercising these rights are detailed in our privacy policy.
14. Force majeure
The establishment cannot be held liable in the event of non-performance or delayed performance resulting from a case of force majeure as defined by Swiss case law (exceptional weather conditions, natural disasters, pandemics, strikes, decisions of the authorities, major technical failure, etc.).
In the event of the impossibility of honouring a reservation, the establishment will propose an equivalent alternative accommodation or, failing that, a refund of the sums paid, to the exclusion of any other compensation.
15. Complaints
Any complaint relating to the stay or the services must be reported without delay to the establishment's staff during the stay, so that a solution can be sought. Failing this, a written complaint may be sent within 30 days of departure by email to hotel@grand-chalet.chor by postal mail to the hotel's address.
16. Modification of the GTC
Le Grand Chaletreserves the right to modify these GTC at any time. The applicable version is the one in force on the date of the reservation. The current version is published on the establishment's website.
17. Severability clause
If any of the provisions of these GTC were to be declared null or inapplicable, the other provisions would remain fully in force. The provision concerned would be replaced by a valid provision whose content most closely matches the original intention of the parties.
18. Applicable law and place of jurisdiction
These GTC are governed by Swiss law, to the exclusion of the rules of conflict of laws and the Vienna Convention on the International Sale of Goods.
The exclusive place of jurisdiction is set at the registered office of the establishment, in Leysin (Vaud, Switzerland), subject to mandatory provisions in favour of consumers.
